Hello,

Yes could be true but check your contract that you signed with them and see if that is in there. If not then point it out to them that it was not stated in the contract.

Hi there, I'm Ice. I submitted my resignation letter stating that I am resigning immediately because my mother has been sickly and I need to go home asap . I was told that I still need to render 30days despite the reason stated on my letter. Is this valid for them not to accept my letter? If that's the case, if I request for End of Contract, will I be entitled to get my last pay? Please advise!

Hi every one,

Sorry for the late reply.

You all have to go over the contract that you signed and look at the company hand book to find the information that you are looking for. You might be able to ask the company for this if you do not have a copy they should.

Far as I know if you are AWOL you are not entitled to any thing but you need to look at your contract and see if its stated in there.

Also your back pay is your back taxes and what ever 13th month pay you got up to, like if you worked 6 months I believe that you should get half of your 13th month but again you all need to look at your contracts.

hi i was tagged as AWOL though i processed my clearance submitted all that is needed to be sent back and just found out that i cannot get my back pay because i was AWOL

eventhough i am awol or terminated do i still have a right to get my back pay right?
i was tageed awol once and was also termed but i was still able to get my backpay complete with my 13th month and tax refund

i just need to know if i can make a complain to DOLE about this because this company has been so abusive of their powers as an employer.. thanks!

From what I under stand in a call center there are no month to month contracts for agents or if I remember correctly my lawyer said no one has gone to court about it.

You gotta under stand in the call center business accounts or campaigns come and go, only a couple last a while so one of the reasons I would think that they put her on floating. I have done this before because I liked the agents that worked for me and did not to lose them.

If she is that hurt over it she can contact labor and file a case but I would not suggest it. I would just tell her to look for another job because it will be allot easier and also if I know that she filed a labor case with another company call center related I would never hirer her.

Hope that helps.

If she likes she can put here info here and might get a job.

My friend was employed in a call center company that has a monthly contract; meaning, each month, her contract is renewed depending on her performance. If she did not perform according to the metrics set by the company, then there is no renewal of contract to be expected. She had been with this company since march 26, 2011. Early this month, her account closed and she was re-profiled to a different account. She underwent training for at least 2 weeks and at the end of her training, she was advised that the company will not certify her for that specific account despite her impressive performance because as per her company, "it's a matter of choice that we will not certify you." Because of this, she was advised that there will be no renewal of contract supposed to happen on the 26th of this month (August). She met with HR on August 16, 2011 and was advised by HR that her employment status is "floating". That is, they will "try" their best to find an account for her, before her end of contract date which is on the 26th, and until then, she can just come in to the office until the 26th of August. On the 18th of August, she was advised by HR that there is not a need to come in to the office until the 26th because they are terminating her contract. So, as per HR, 18th of August was the last day of her work, and she will only be paid until the 19th of August instead of the original date which is August 26 (End of Contract date).

Is it even legal for the company to just dismiss her without any valid reason, and for the company to not extend her pay until the end date on her contract which is 26th of August?

Please advise.
